Fatal accident causes injuries and death in New York

The families of people who are injured or killed in New York car accidents are typically wrought with disbelief and sorrow. This sorrow may turn to anger if a person’s failure to obey several road rules led to the fatal accident. In this type of situation, it is within the rights of the family members to file a wrongful death lawsuit or for an injured victim to file a personal injury claim, which can help them to move forward after the tragedy.

A 9-year-old boy was recently killed in an auto accident. The accident occurred when a 59-year-old man was driving and trying to make a turn. That is when he hit a parked car while trying to avoid hitting two pedestrians at a crosswalk. Police said that the man drove onto a sidewalk, hit a building and another parked car and drove the wrong way down the street. He then hit another car, authorities said.

At that point, the man allegedly hit a 28-year-old woman along with the 9-year-old boy and a 5-year-old boy and a 48-year-old woman. The 9-year-old died at the scene of the accident. Two of the other individuals suffered injuries, while the other one was relatively unharmed, police said. The man was arrested and faces several charges, including failure to yield right of way, driving a vehicle on a sidewalk, reckless driving, wrong-way driving, negligent homicide, criminal mischief and assault.

The family of the deceased victim, as well as those who were injured in the fatal accident, have the right to pursue financial damages in an effort to ease pain and suffering. The man’s charges can be used to establish liability in civil court in New York. Once liability is established in a manner that meets the court’s standards, claims for monetary damages will be decided in favor of the victims.
