Motor vehicle accident leads to death of woman in New York

Getting into a car wreck can certainly be physically and emotionally traumatizing for an injured victim, but it can especially be emotionally traumatizing for the family members of a deceased victim. The incident may particularly spark rage in the loved ones who are left behind if the victim died through no fault of his or her own, and the accident was seemingly preventable. In this scenario, the family members have the right to seek financial damages against the person who is deemed to have caused a tragic New York motor vehicle accident.

An accident recently occurred when a car flipped in the New York Borough of Queens. The crash started when a car struck and flipped the car that a 56-year-old woman was driving. The woman whose vehicle was struck suffered serious injuries and was transported to the hospital, authorities reported.

The woman later died at the hospital, police said. The man who struck her was 24 years old and apparently told witnesses that he did not see the woman coming. Police continue to investigate the accident.

The man whose vehicle is said to have hit the woman’s automobile may experience legal issues if the family of the deceased woman decides to sue him for monetary damages in connection with the fatal vehicle accident. These could include hospital expenses and end-of-life costs, as well as other financial losses recognized under New York wrongful death laws. If there is proof that the man was speeding, driving while distracted and/or disobeying another traffic rule when the crash occurred, this evidence could be used to establish his financial responsibility for the losses incurred due to the accident. A civil court in New York would decide the monetary damage claims if liability is established by a preponderance of the evidence.
