2-year-old boy dies in fatal accident in New York

New Yorkers who leave their home to complete errands with a baby in tow certainly don’t expect to later become caught up in a fatal accident that results in the death of the child. Upon hearing the news, family members are typically distraught and in shock over the catastrophe. They may also feel anger toward the person who caused a preventable fatal accident. The family members of the deceased victim have the right to file a lawsuit against the person who is thought to have caused the crash, seeking financial damages.
A head-on collision recently occurred in New York. A car that was trying to escape from the police ended up striking a vehicle in which a woman and her 2-year-old toddler were riding. The boy died in the crash.
A 35-year-old woman was driving the vehicle that police said hit the 2-year-old’s car. She also died in the collision. The mother of the toddler suffered minor injuries in the vehicle accident. Police said the 35-year-old woman had been trying to evade police after being involved in a larceny situation in a department store.
The woman who lost her toddler son in the crash reserves the right to file a suit against the woman who allegedly caused the head-on crash. Although the individual deemed responsible died in the crash, the family of the young victim can still file a wrongful death claim against the woman’s estate as well as any other person who also owned the vehicle that was involved in the fatal accident. In the suit, the boy’s loved ones can seek monetary damages that could cover end-of-life expenses, funeral costs and other damages as provided under New York wrongful death laws.
