New York bicyclist killed in auto accident

Despite last week’s discussion about bicycle safety, another bicyclist was killed recently here in New York. Reports indicate the victim was biking east when a westward vehicle struck him, throwing him from his bike. He was airlifted to the hospital, but he later died from his injuries. The accident, which occurred late at night, remains under investigation.

Losing a loved one in a fatal accident can be devastating. Surviving family members may be heartbroken to know they will never hear their loved one laugh again or celebrate holidays and major life events. While this emotional pain is more than many can bear, they often also have to deal with the stark financial difficulties thrust upon them. If a family relied on their lost loved one’s income, then they may have difficulty making everyday bills. Also, incurred medical and funeral expenses can exacerbate the situation.

In many cases, the only way families can recover these damages and hold a negligent driver accountable is to file a wrongful death lawsuit. A winning case very well may bring a family compensation for medical expenses, funeral costs, lost wages, and pain and suffering, but these claims are often fiercely fought. Therefore, it may be helpful for a victim to obtain the assistance of a legal professional who will aggressively fight for the person’s legal rights.

In some cases, with the right help, negotiations can be utilized in an attempt to reach a settlement. If a settlement cannot be reached, then the case may go to trial. Utilizing applicable law and capitalizing on legal argument skills, a competent attorney will give a victim the best possible chance of success.
